2. Scope of application

These Terms and Conditions of Sale apply to all orders placed through the site moienmoney.com by consumers or professionals, within the limits provided by applicable law.

By placing an order on the site, the Customer declares that they have read and accepted these terms.

3. Products sold

Moien Money may sell:

• Digital products: PDF files, downloadable materials, printable activities, guides or similar digital content.
• Physical products: printed materials, kits, games, accessories or other products shipped physically.
• Mixed products: products combining a physical part and a digital part.

The photographs, illustrations and images shown on the site are indicative. There may be minor variations in colour, format, printing, finish or presentation.

4. Pre-contractual information

Before confirming the order, the Customer has access to the main characteristics of the products, the price, payment methods, any shipping costs, delivery or availability times and these Terms and Conditions of Sale.

5. Prices

Prices are indicated in euros (€). Unless otherwise stated, prices include applicable taxes according to the seller’s tax situation.

Any shipping costs, fees or additional costs are displayed before final validation of the order.

Moien Money reserves the right to change prices at any time. The applicable price is the one indicated at the time the order is confirmed.

6. Order and acceptance

The order is validated when the Customer confirms the cart, provides the necessary information, accepts these terms and makes payment.

After validation, the Customer receives confirmation by email. Moien Money reserves the right to refuse or cancel an order in the event of obvious error, suspected fraud, impossibility of fulfilment or payment problem.

7. Payments

Payments may be made through the methods available at checkout, including bank card, Stripe, PayPal, Apple Pay or other methods indicated on the site.

Full card details are not stored on Moien Money servers. Payment processing is carried out by secure external payment providers.

8. Delivery of digital products

Digital products are made available after payment validation, through a download link, customer area, email or another method indicated on the site.

In the event of technical difficulty accessing the file, the Customer should contact info@moienmoney.com.

9. Licence to use digital materials

The digital materials purchased are intended exclusively for the Customer’s personal, family or private educational use, unless expressly authorised in writing.

It is prohibited to:

• resell, redistribute or publicly share the files;
• publish the materials on websites, social networks, groups, platforms, public drives or marketplaces;
• alter the files for resale or commercial use;
• reproduce the materials on a large scale without authorisation;
• remove trademarks, credits, notices or identification elements of Moien Money.

10. Shipping of physical products

Physical products are shipped to the address provided by the Customer when ordering. The Customer is responsible for providing complete and correct details.

• Shipping origin: Luxembourg.
• Carriers: POST Luxembourg, Mondial Relay or other carriers indicated at checkout.
• Timeframes: preparation and delivery times are indicative and may vary.
• Shipping costs: shown before the order is confirmed.

Moien Money is not responsible for delays caused by carriers, strikes, address errors, absence of the recipient, customs or events beyond its control.

11. Transfer of risk and ownership

Ownership of the products transfers after full payment. The risk of loss or damage transfers under the terms provided by applicable law, in particular at the time of delivery to the Customer or to a third party designated by the Customer.

12. Right of withdrawal — physical products

The consumer Customer has, in principle, a period of 14 calendar days to exercise the right of withdrawal, without giving any reason, from receipt of the goods.

To exercise this right, the Customer must inform Moien Money by email at info@moienmoney.com, using a clear statement or the model form included at the end of these terms.

Products must be returned complete, unused, in good condition and, where possible, in their original packaging. The Customer bears the direct return costs, except in the case of an error attributable to Moien Money or contrary legal provision.

13. Refund after withdrawal

In the event of valid withdrawal, Moien Money refunds the amounts received, including standard delivery costs, within the applicable statutory period after receipt of the withdrawal decision.

Moien Money may defer the refund until it has received the returned goods or until the Customer provides proof of shipment, as permitted by applicable law.

14. Exceptions to the right of withdrawal

The right of withdrawal may not apply, in particular, to:

• digital content made available immediately, where the Customer has given prior express consent and acknowledged the loss of the right of withdrawal after download/access begins;
• personalised products or products made to the Customer’s specifications;
• sealed products that cannot be returned for hygiene or health protection reasons after opening;
• products that are damaged, incomplete or used in a way exceeding simple verification of their characteristics.

15. Damaged products, error or non-conformity

If the product received is damaged, incorrect or non-compliant, the Customer must contact Moien Money at info@moienmoney.com, ideally within 48 hours of receipt, attaching photographs and a description of the problem.

After review, an appropriate solution may be proposed: replacement, correction, reshipment, credit or refund, depending on the case and applicable law.

16. Legal guarantees

The Customer benefits from the applicable legal guarantees regarding conformity and hidden defects, under the terms provided by European Union and Luxembourg law.

Improper use, normal wear and tear, poor maintenance, modification by the Customer or use outside the instructions may exclude or limit Moien Money’s liability.

17. Products intended for children

Some Moien Money materials are designed for use by children, but must be used under the supervision of a responsible adult.

Small parts, printed materials, accessories, coins, markers, manipulable elements or similar components may pose a risk if used improperly.

18. Limitation of liability

Moien Money materials are educational and playful in purpose. They do not constitute professional financial, legal, medical, psychological or pedagogical advice.

Moien Money is not liable for indirect damage, loss of data, loss of opportunity, misuse of materials or results obtained by the Customer through use of the products.

19. Personal data

The processing of personal data necessary for managing orders, payments, shipping, support, customer account and communications is described in the Privacy and Cookies Policy.

20. Complaints and customer support

21. Dispute resolution

In the event of a dispute, the Customer is invited to contact Moien Money beforehand to try to reach an amicable resolution.

22. Applicable law

These Terms and Conditions of Sale are governed by the law of the Grand Duchy of Luxembourg, without prejudice to mandatory consumer protection provisions applicable in the Customer’s country of residence.

23. Changes to the terms

Moien Money may update these terms at any time. The applicable version is the version published on the site at the time of the order.
